These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services provided by CardRanks LLC (“CardRanks,” “we,” “us,” or “our”), including https://cardranks.app and any related products and services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Who We Are
CardRanks LLC is a Washington limited liability company. You can contact us at support@cardranks.app or by mail at 100 N Howard St. Ste. R, Spokane, WA 99201.
2. The Services
CardRanks is a platform for browsing trading card data, rankings, and prices; creating user accounts and sub-profiles; contributing community posts, comments, lists, and favorites; running head-to-head card duels with Elo-style ranking; and accessing optional paid features or subscriptions.
Card prices, rankings, and related data are estimates compiled from third-party sources and user contributions and are provided “as is” for informational purposes only. CardRanks is not a marketplace, broker, dealer, grader, or appraiser. We do not buy, sell, authenticate, appraise, or guarantee the value, condition, or grade of any card. You should independently verify any information before relying on it for purchase, sale, trade, insurance, or investment decisions.
2.1 Market Watch and Price Alerts
Market Watch is an optional, paid feature that lets you track cards on third-party marketplaces (initially eBay) and receive alerts when listings match the price conditions you set, plus on-demand “See what’s available now” lookups. Marketplace listings, prices, and availability are supplied by third parties, are not controlled or verified by CardRanks, and can change, sell out, or be removed at any time.
We do not guarantee that alerts will be delivered or that they will be accurate, complete, or timely, and we are not a party to and have no responsibility for any transaction you enter into on eBay or any other marketplace. Daily watch, alert, and lookup limits apply by plan and may change. eBay is a trademark of eBay Inc. CardRanks participates in the eBay Partner Network affiliate program and accesses eBay marketplace data under eBay’s API License Agreement; except for that affiliate relationship, CardRanks is not affiliated with, endorsed by, or sponsored by eBay.
2.2 Affiliate Links and Disclosure
CardRanks participates in the eBay Partner Network and may participate in other marketplace affiliate programs in the future. Some links to eBay and other marketplaces in the Services are affiliate links. If you click an affiliate link and make a qualifying purchase, CardRanks may earn a commission, at no additional cost to you.
Affiliate commissions do not influence which cards we show you, your rankings, or your duel results — those are determined solely by your own activity and the data you contribute. For how affiliate links handle your information, see our Privacy Policy.
3. Eligibility
The Services are intended for users at least 13 years of age. If you are under 18 (or the age of majority where you live), you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Services, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.
4. Accounts
Some features require an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your credentials and for all activity that occurs under your account, including activity by any sub-profiles you create. Notify us immediately at support@cardranks.app of any unauthorized use. We may reclaim or change usernames that are, in our sole discretion, inappropriate, infringing, or impersonating.
5. User Content
“User Content” means anything you post, upload, submit, or otherwise make available through the Services, including profiles, community posts, comments, lists, ratings, photos, and card contributions.
You retain ownership of your User Content. By submitting User Content, you grant CardRanks a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, translate, distribute, publicly display, and create derivative works of your User Content for the purpose of operating, providing, improving, and promoting the Services. This license survives termination of your account with respect to copies retained for backup, legal, or operational purposes, and with respect to User Content that other users have already incorporated into their own activity on the Services.
You represent and warrant that:
- you own or have the necessary rights to grant the license above;
- your User Content does not infringe any third party’s intellectual property, privacy, or publicity rights;
- your User Content is not unlawful, false, misleading, defamatory, obscene, harassing, hateful, or otherwise objectionable;
- your User Content does not contain malware, spam, or unauthorized advertising.
We may, but are not obligated to, review, edit, remove, or refuse User Content for any reason. We are not responsible for User Content posted by users.
6. Acceptable Use
You agree not to:
- use the Services in violation of any law or these Terms;
- scrape, crawl, or systematically retrieve data from the Services without our prior written permission, or build a competing product or dataset from the Services;
- reverse engineer, decompile, or attempt to extract source code from the Services, except as permitted by law;
- interfere with, disrupt, or impose an unreasonable load on the Services or any networks connected to the Services;
- access the Services through automated means (bots, scripts) without our prior written permission, beyond ordinary search-engine indexing;
- manipulate, falsify, or coordinate the submission of card prices, rankings, reviews, votes, or other Contributions in a misleading way;
- impersonate any person or entity, or misrepresent your affiliation;
- harass, abuse, threaten, or harm any other user;
- upload viruses, worms, or other malicious code;
- collect or harvest user data without consent;
- use the Services for unsolicited advertising, spam, pyramid schemes, or similar.
7. Intellectual Property
The Services, including all software, text, design, graphics, logos, and the CardRanks name and marks, are owned by CardRanks or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use, subject to these Terms.
Card names, set names, character names, artwork, logos, and other indicia of trading card games and properties displayed on the Services are the property of their respective owners (including The Pokémon Company International, Nintendo, Game Freak, Creatures Inc., Wizards of the Coast, Konami, Upper Deck, Topps, Panini, and other rights holders). CardRanks is not affiliated with, endorsed by, sponsored by, or otherwise officially connected to any of these rights holders unless expressly stated. All third-party trademarks and copyrighted materials remain the property of their respective owners and appear on the Services for identification and informational purposes under principles of nominative fair use.
8. Feedback
If you send us suggestions, ideas, or feedback, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use them for any purpose without compensation or attribution.
9. Purchases and Subscriptions
Some Services may be offered for a fee or as a subscription. You agree to provide accurate billing information and to pay all applicable fees and taxes. Subscriptions renew automatically until cancelled. You can cancel at any time by managing your subscription in your account or by emailing support@cardranks.app. Cancellation takes effect at the end of the then-current billing period.
Except where required by law, all sales and subscription fees are non-refundable. We may, in our sole discretion, issue refunds or credits on a case-by-case basis. To request a refund, contact support@cardranks.app within thirty (30) days of the original charge. We may change prices at any time; price changes apply to billing periods after we notify you.
10. Third-Party Services and Links
The Services may contain links to or integrations with third-party websites, products, or services that we do not control. We are not responsible for the content, policies, or practices of any third party. Your dealings with third parties are solely between you and them.
11. Privacy
Our Privacy Policy explains how we collect and use your information. By using the Services, you agree to our Privacy Policy.
12. Termination
You may stop using the Services at any time and delete your account from your /profile page or by contacting us. We may suspend or terminate your access at any time, with or without notice, including if we believe you have violated these Terms, created risk or legal exposure for us, or for any other reason in our sole discretion. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, dispute resolution, and miscellaneous) will survive.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY INFORMATION (INCLUDING CARD PRICES, RANKINGS, GRADES, AUTHENTICITY ASSESSMENTS, OR OTHER CARD-RELATED DATA) WILL BE ACCURATE, CURRENT, OR RELIABLE. ANY RELIANCE YOU PLACE ON CARDRANKS DATA IS AT YOUR OWN RISK.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CARDRANKS AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
15. Indemnification
You agree to defend, indemnify, and hold harmless CardRanks and its members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Services; (c) your violation of these Terms; (d) your violation of any law or any third party’s rights.
16. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully — it affects your legal rights.
17.1 Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by emailing support@cardranks.app with a description of the claim and the relief you seek. We’ll try to resolve it within 30 days.
17.2 Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, in Whatcom County, Washington (or remotely if you so elect for claims under $25,000). Judgment on the award may be entered in any court of competent jurisdiction.
17.3 Class Action Waiver. YOU AND CARDRANKS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
17.4 Exceptions. Either party may bring (a) a claim in small-claims court if it qualifies, or (b) an action for injunctive or other equitable relief to protect intellectual property rights, in the state or federal courts located in Whatcom County, Washington. You and CardRanks consent to the personal jurisdiction of those courts for such actions.
17.5 Time Limit. Any claim must be filed within one (1) year after it arises, except where applicable law prohibits a shorter limitation period.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice (such as an in-app message or email). Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
19. California Users
Under California Civil Code § 1789.3, California users are entitled to the following notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
20. Miscellaneous
These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and CardRanks regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them freely. No agency, partnership, joint venture, or employment relationship is created by these Terms.
